The Privacy Policy is part of the General Terms and Conditions governing the Website www.aquib.es along with the Cookie Policy and the Legal Notice.

The BALEARIC AGENCY FOR QUALITY ASSURANCE IN HIGHER EDUCATION (AQUIB) reserves the right to modify or adapt this Privacy Policy at any time. Therefore, we recommend that you review it each time you access the Website. If a user has registered on the website and logs into their account or profile, they will be informed if there have been substantial modifications regarding the processing of their personal data.

AQUIB publishes the Register of Processing Activities of AQUIB (2022).

Who is responsible for processing your data?

The data that is collected or voluntarily provided by you through the Website—whether through browsing, contact forms, email or telephone—will be collected and processed by the Data Controller, whose details are as follows:

If, for any reason, you wish to contact us regarding matters related to the processing of your personal data or privacy (with our Data Protection Officer), you may do so via any of the above-mentioned channels.

What data do we collect via the website?

By merely browsing the Website, AQUIB will collect the following information:

  1. IP address
  2. Browser version
  3. Operating system
  4. Duration of visit or browsing session

The information we handle will not be associated with a specific user and will be stored in our databases for the purpose of statistical analysis, improvements to the Website, products and/or services, and to enhance our commercial strategy. This data will not be shared with third parties.

User registration / Form submission

If it is necessary for the user to complete a form in order to access certain services, a series of personal data will be requested. These data will be necessary and mandatory to carry out the registration. If such fields are not provided, the registration will not proceed.

In this case, browsing data will be associated with the user’s registration data, identifying the specific user browsing the Website. This allows customization of the products and/or services offer that we consider best suited for the user.

The registration data of each user will be added to AQUIB’s databases, along with their transaction history, and will be stored as long as the registered account exists. Once the account is deleted, such information will be removed from our databases, except for transaction-related data, which will be retained offline for 10 years to comply with legally mandated retention periods. Data not linked to transactions will be retained unless consent is withdrawn, in which case they will be deleted immediately (in accordance with legal timeframes).

The legal basis for processing your personal data is the execution of a contract between the parties.

Regarding the sending of electronic communications and responding to information requests, the lawful basis of processing is the user’s consent.

  1. Manage your access to the Website.
  2. Manage the services made available through the Website.
  3. Keep you informed about the processing and status of your requests.
  4. Respond to your information requests.
  5. Manage all utilities and/or services offered by the platform to the user.

What is the legal basis for processing your data?

The data subject’s acceptance and consent: In cases where filling in a form and clicking “submit” is necessary to make a request, doing so implies you have been informed and have expressly consented to the clause attached to the form or accepted the Privacy Policy. All our forms include a checkbox with the following wording:

How long will we keep personal data?

We can only consult or delete your data while you keep a specific profile. We will process it as long as you remain connected with us—being friends, liking, following or similar actions.

Any data rectification, restriction or publication removal must be made through your profile settings on the social network itself.


AQUIB USERS

Purposes:

  1. Provide any information, including electronic, related to your request.
  2. Inform you by electronic means where there is express authorization.
  3. Manage administrative, communications, and logistical services provided by the Data Controller.
  4. Carry out relevant transactions.
  5. Any other necessary action for proper service delivery.

Legal basis:

Your consent, contract execution, and legal obligations.

SUPPLIERS

Purposes:

  1. Provide information related to your request electronically.
  2. Commercial or event information electronically, if expressly authorized.
  3. Manage administrative, communications, and logistical services provided by the Data Controller.
  4. Invoicing.
  5. Carry out relevant transactions.
  6. Tax accounting and declaration.
  7. Control and recovery management.

Legal basis:

The legal basis is either the acceptance of a contractual relationship, or, failing that, your consent when contacting us or offering your products.


JOB APPLICANTS

Purposes:

  1. Organize recruitment processes.
  2. Schedule interviews and evaluate your candidacy.
  3. If you have consented, we may share it with collaborating entities solely to assist you in finding employment.

Legal basis:

Your unequivocal consent when submitting your CV and signing information about processing.

How long will personal data be retained?

Resumes will be stored for one year, after which, if we have not contacted you, they will be deleted.


HR

Purposes:

  1. Manage employment relationship and employee records.
  2. Perform all administrative, fiscal, and accounting procedures required by law.
  3. Manage payroll payments via financial institutions.
  4. Time tracking using access systems (biometric/card).
  5. Administer collective insurance/pension plans.
  6. Provide training, both subsidized and non-subsidized.

Legal basis:

Execution of your employment contract, compliance with legal obligations, and your consent.

Do we include personal data of third parties?

Generally no—we process only data provided by the relevant individuals. If you supply third‑party data, you must inform and obtain prior consent from those persons; otherwise, you exempt us from responsibility for non‑compliance.

What about data of minors?

We do not process the data of minors under 14. Therefore, do not provide it unless you meet that age. In any case, AQUIB’s services are intended for persons aged 18 and over.

Will we send communications by electronic means?

  1. Only to manage your request, if you provided that contact method.
  2. If we send commercial communications, they will have been expressly authorized by you.

What security measures do we apply?

Rest assured: we have adopted an optimal level of protection for the personal data we process and installed all technical measures available to avoid loss, misuse, alteration, unauthorized access, or theft.

To what extent is decision‑making automated?

AQUIB does not use fully automated decision‑making processes to enter into, develop, or terminate a contractual relationship with the user. If used in a particular case, we will inform you and communicate your rights if legally required.

Will profiling occur?

AQUIB does not make automated decisions based on profiles.

To whom will your data be communicated?

  1. AQUIB.
  2. Your data may be shared with collaborating entities and public Administrations for proper service delivery or if legally required.
  3. If you consent to the use of your name, images, or other information related to AQUIB’s activities, it may be published on the website.

International transfers.

If international data transfers by AQUIB are necessary, they will be carried out in compliance with the GDPR or other applicable regulations. To that end, the company will adopt any necessary agreements to ensure an adequate level of data protection equivalent to that provided by EU regulations.

In cases involving shared folder systems (Dropbox, Google Drive, Microsoft OneDrive, Amazon, Apple, HubSpot, etc.), an international transfer to the United States will be conducted under GDPR Article 49(c) or another mechanism guaranteeing EU-equivalent data protection.

What rights do you have?

  1. To know if we are processing your data.
  2. To access your personal data.
  3. To request correction of inaccurate data.
  4. To request deletion if data are no longer necessary or consent is withdrawn.
  5. To request processing restriction in certain cases, in which case we will only retain data in accordance with legal obligations.
  6. To data portability: your data will be provided in a structured, commonly used, machine-readable format. If you prefer, we can send it directly to another controller designated by you (when applicable).
  7. To file a complaint with the Spanish Data Protection Agency if you believe your rights have not been properly attended to.
  8. To withdraw consent for any processing for which you have consented, at any time.
  9. If you modify any data, please let us know to keep it up to date.

Want a form to exercise your Rights?

  1. We have forms available—request them by email or use those provided by the Spanish Data Protection Agency or other sources.
  2. These forms must be electronically signed or accompanied by a copy of your ID.
  3. If someone represents you, they must also provide their ID copy or sign electronically.
  4. Forms can be submitted in person, by mail, or by email to the Data Controller’s address at the beginning of this text.
  5. You have the right to file a complaint with the Spanish Data Protection Agency if you consider that your rights have not been properly addressed.

The maximum period for AQUIB to respond is one month from the effective receipt of your request.

You have the right to withdraw consent at any time for any processing you have previously consented to.

Do we process cookies?

If we use cookies other than the strictly necessary ones, you can consult the cookie policy via the corresponding link at the top of our website.

How long will we keep your personal data?

  1. Personal data will be retained as long as you remain associated with us.
  2. Once you dissociate, data processed for each purpose will be kept for legally mandated periods, including the timeframe during which a court may request them based on statutory limitation periods.
  3. Data will be retained until legal deadlines expire or until the data subject requests deletion or withdraws consent, if no legal retention obligation applies.
